Privacy Policy

Harbitt, Inc. ("we", "us", or "our") has established the following privacy policy (this "Policy") regarding the handling of personal information entrusted to us by users of our services ("users") and by our other stakeholders. We promote the protection of personal information by building a framework for its protection, by making all of our employees aware of the importance of protecting personal information, and by ensuring that they act accordingly.
Article 1 (Personal Information)
"Personal information" means personal information as defined in the Act on the Protection of Personal Information (Act No. 57 of 2003; the "APPI"), namely information about a living individual which can identify that specific individual by name, date of birth, or other description contained in the information, or which contains an individual identification code.
Article 2 (Purposes of Use of Personal Information)
We obtain personal information, and use the information we obtain, to the extent necessary for the purposes below. Where we use personal information beyond the scope of these purposes, we will obtain the prior consent of the individual (in this Policy, the specific individual identified by the personal information we obtain) by appropriate means.
- (1) To provide our services (the "Services")
- (2) To improve and enhance the Services, or to develop new services
- (3) To provide information about new features of, updates to, and campaigns for the Services, and about other services we provide (including by email, leaflet, and other direct mail)
- (4) To provide information about exhibitions we take part in and seminars we hold (including by email, leaflet, and other direct mail)
- (5) To contact you as necessary regarding maintenance, important notices, and the like
- (6) To respond to opinions, inquiries, and similar communications from you regarding the Services (including verifying your identity)
- (7) To report to users on their use of the Services
- (8) To request your cooperation with surveys, interviews, and the like regarding the Services, to invite you to events, and to report on the results
- (9) To examine and analyse usage history and similar data for the Services, and to use the results to improve and develop the Services and to deliver advertising
- (10) To provide personal information to companies participating in events we host, based on your approval or application
- (11) To identify users who breach our terms of use, or who attempt to use the Services for improper or unjust purposes, and to refuse them access
Article 3 (Use of Cookies and Similar Technologies)
We may use cookies and other information-collection modules ("cookies etc.") to obtain access and browsing information about users of the Services, for purposes such as access analysis. The information obtained through cookies etc. ("cookie information") does not, on its own, include information capable of identifying a user.
- 1. Users may configure the use of cookies etc. on the Services. If you do not wish to permit the use of cookies etc., you may disable them in your browser settings. Note that disabling cookies etc. may impair the usability of the Services or limit the range of services available to you.
- 2. We use cookie information for the operation, quality maintenance, and improvement of the Services, as well as for the development and improvement of our products and services, and to deliver advertising tailored to a user’s use of the Services.
Article 4 (Management and Protection of Personal Information)
We manage personal information strictly and will not disclose or provide it to third parties without the consent of the individual, except in the cases listed below. With safety in mind, we also take measures to prevent and remedy risks such as unauthorised access to personal information and the loss, destruction, alteration, or leakage of personal information.
- (1) Where necessary to protect a person’s life, body, or property, and obtaining the individual’s consent is difficult.
- (2) Where particularly necessary to improve public health or to promote the sound growth of children, and obtaining the individual’s consent is difficult.
- (3) Where necessary to cooperate with a national government body, a local government, or a party commissioned by either, in performing duties prescribed by law, and obtaining the individual’s consent would risk impeding the performance of those duties.
- (4) Where we outsource all or part of the handling of personal information, within the scope necessary to achieve the purposes of use, in order to carry out our business smoothly.
- (5) Where personal information is provided as part of a business succession due to a merger or other reason.
- (6) Where personal information is used jointly with a specific party, and we have given prior notice to the individual, or placed in a state where the individual can readily know, of that fact together with the items of personal information used jointly, the scope of the parties using it jointly, their purposes of use, and the name of the party responsible for the management of that personal information.
- (7) Where otherwise permitted by law.
Article 5 (Provision to Third Parties in Foreign Countries)
In order to achieve the purposes of use set out in Article 2, we provide personal information to third parties in foreign countries that have taken equivalent protective measures. We take the measures necessary to ensure that such third parties continue to implement those equivalent measures, and we will provide information about those necessary measures on request from the individual.
Article 6 (Outsourcing the Handling of Personal Information)
We may outsource all or part of the handling of personal information within the scope necessary to achieve the purposes of use. In such cases, we sufficiently examine the suitability of the contractor and exercise necessary and appropriate supervision over it, including by setting out confidentiality obligations and similar matters in the contract.
Article 7 (Joint Use of Personal Information)
We may use users’ usage information jointly, within the scope necessary to achieve the purposes of use, to the extent and for the purposes set out below.

Article 8 (Disclosure of Personal Information)
You may request disclosure of the personal information we retain, in accordance with the procedure set out in Article 11. On receiving such a request, we will disclose the information to you without delay. However, we may withhold all or part of the disclosure where it would fall under any of the following, and where we decide not to disclose, we will notify you of that decision without delay.
- (1) Where disclosure would risk harming the life, body, property, or other rights and interests of you or a third party
- (2) Where disclosure would risk significantly impeding the proper conduct of our business
- (3) Where disclosure would otherwise breach the law
Article 9 (Correction of Personal Information)
- 1. Where the personal information we retain about you is inaccurate, you may request the correction, addition, or deletion of that personal information ("correction etc.") in accordance with the procedure set out in Article 11.
- 2. On receiving a request under the preceding paragraph, we will carry out the necessary investigation without delay and, if we determine that the request is well founded, will make the correction etc. without delay.
- 3. Where we decide whether or not to make a correction etc. under the preceding paragraph, we will contact you without delay.
Article 10 (Suspension of Use of Personal Information)
- 1. You may request the suspension of use, the erasure, or the suspension of provision to third parties of the personal information we retain ("suspension of use etc.") in accordance with the procedure set out in Article 11.
- 2. On receiving a request under the preceding paragraph, we will carry out the necessary investigation without delay and, if we determine that the request is well founded, will effect the suspension of use etc. However, where the suspension of use etc. would require substantial expense, or is otherwise difficult, and we can take an alternative measure necessary to protect your rights and interests, we will take that alternative measure.
- 3. Where we decide whether or not to effect a suspension of use etc. under the preceding paragraph, we will contact you without delay.
Article 11 (Procedure for Disclosure and Related Requests)
To make a request under Articles 8 to 10, please prepare a document setting out the required particulars specified in (1) below and send it, together with the identity documents specified in (2), to the address specified in (3). A fee of 1,000 yen applies to each request for disclosure of personal information.

Article 12 (Procedure for Amending this Policy)
We review the contents of this Policy from time to time and strive to improve it. Except for matters otherwise provided by law or in this Policy, the contents of this Policy may be changed. An amended privacy policy takes effect when we notify the individual by the means we prescribe, or publish it on our website.
Article 13 (Compliance with Laws and Standards)
We comply with the laws of Japan and other standards that apply to the personal information we retain.
Article 14 (Handling Complaints and Consultations)
We accept complaints and consultations from individuals regarding the handling of personal information and respond to them appropriately and promptly. We also respond promptly and appropriately to requests from individuals for the disclosure, correction, addition, or deletion of their personal information, or for the refusal of its use or provision.
Article 15 (Security Control Measures)
We prevent unauthorised intrusion into personal information, and the loss, destruction, alteration, or leakage of personal information entrusted to us, by taking organisational, physical, personnel, and technical measures, including restricting access to personal information files, recording access logs, and implementing security measures to prevent unauthorised external access. In the unlikely event of an incident such as a leakage of personal information, we will promptly report it to the supervisory authority in accordance with the APPI and related guidelines, and will take the necessary action, including measures to prevent similar incidents and to prevent recurrence, in accordance with that authority’s instructions.
